Employees of Kailali protest against the proposed civil service bill
Employees of Kailali have protested against the proposed civil service bill by the central government.
The District Committee of the Official Trade Union of Civil Servants has sent a memorandum to the Prime Minister through the district administration on Thursday stating that the proposed bill will destroy the entirety of the civil service mechanism.
Employees, led by district chairman Prem Bahadur Bogat, handed over the memorandum and demanded its rejection saying that it was an attempt to bring a bill against the constitution and against the convention of the International Labor Organization. They have made a 17-point demand to the Prime Minister.

Disagreement with the Honourable Minister of Federal Affairs and General Administration regarding Article 34 (3) of the Constitution, Article 180, Sub-Article 1 (b) of the Labour Act 2074 and the Convention of the International Labour Organization (ILO), and the Committee on State Management and Good Governance of the Official Trade Union District Working Committee Kailali regrets that the bill was passed in the name of majority without any quorum. The proposed Civil Service Bill is currently completely retrograde and unjust in terms of service facilities, service security, and professional development of all levels and categories of employees which has the employees in an agitated state psychologically and physically. Federal Parliament has agreed to make arrangements for the formation, operation and conditions of service of the Federal Civil Service In this context, regarding the security of service condition of Article 58 of the Civil Service Act, 2049 BS, he said, Contrary to the provisions of the explicit provision, all the civil servants have been affected by the conditions of service contrary to the consent and acceptance of all the employees.
It is clear that the Federal Civil Service Bill proposed by the State Management and Good Governance Committee is an attempt to destroy the civil service mechanism. In the second historic people's movement of 2062-06, the commitment made by the then seven political parties to establish trade union rights for the civil servants where the bill was passed by the State Management and Good Governance Committee without including the national level trade unions.
Regarding the terms and conditions of service, facilities and trade union rights in the existing Civil Service Act, 2049 BS, Hon'ble Prime Minister K.P. Contrary to the commitment made by Sharma Oliju at the Civil Service Day Main Ceremony on September 7, 2075 BS, there is no reduction in the existing trade union rights.
The report passed by the Committee on State Management and Good Governance has raised many complaints from various pressure groups of civil servants working in different departments and levels about the undemocratic provisions and the conclusion of the official trade unions and national level trade unions is that these issues are justified.
In order to motivate the general employees who work in the field, the implementation of state policies and programs in accordance with the law, timely provisions should be made in the provisions of trade union rights, protection of service conditions, recruitment and career development in the Civil Service Act, 2049 (Amendment 2064). Retroactive provisions that cut even the rights and service facilities obtained can never be accepted. Instead of addressing the demands made by the official trade unions to the Ministry of Federal Affairs and General Administration in consultation with the national trade unions to formulate a federal civil service act to ensure speedy civil service flow and guarantee the rights of employees. Therefore, we demand to repeal such provisions mentioned in the bill and make arrangements to issue the Federal Civil Service Act as soon as possible. If the Act is issued without addressing these legitimate demands, we would like to inform you that we will be compelled to carry out more agitation programs.
Details
1. Article 53 of the Civil Service Act 2049 provides for social dialogue and collective bargaining.
2. Respecting the essence and spirit of federalism, arrangements should be made for the chief secretary of the state to be from the federal civil service, the secretary and the chief accountant to be from the state civil service and the chief administrative officer and the chief accountant to be from the local service.
3. To ensure the provision of vacancies as per Section 6 (a) of the Civil Service Act, 2049 BS in relation to the internal/open competitive written examination in the proposed bill as follows,

In the case of employees who have been adjusted under the Employees Adjustment Act, 2075 BS, there should be a clear provision of the legal basis for the transfer of union/state after a certain period after the promulgation of Federal Civil Service Act, State Civil Service Act, and Local Service Act. 5. In the definition of a civil servant, it should be mentioned that the civil servants working in the federal civil service and the civil servants who have been adjusted at the state and local level as per the federal law should be referred.
6. The current system of not limiting the age limit for the employees retiring in the civil service while competing for the open and internal posts of the federal civil service and extending the previous service period after promotion should be maintained.
7. Employee transfer systems need to be automated, cyclical, predictable and scientific,
8. One of the systems should be implemented to bring uniformity in the existing hierarchical and hierarchical system at the federal, state and local levels,
9. Necessary arrangements should be made for the establishment of Civil Servants Welfare Fund and operation of Civil Hospitals, Multi-Technical Civil Servants Colleges, Civil Servants Accessible Loan Scheme and other civil welfare programs/schemes.
10. With regard to the employees who have been appointed before the 21st of Kartik, 2049 BS, the service facilities including pension as per Section 37 (3) of the Civil Service Act 2049 BS should be maintained.
11. As per the Civil Service Act 2049, the service conditions and facilities of the civil servants should be maintained,
12. To maintain the provisions of the existing Civil Service Act, 2049 in the geographical area,
13. The two-tier upgrading provision in the existing Health Services Act should be maintained,
14. Advertising should be ensured in the sixth and eighth levels of health care,
15. Provision should be made for the employees who have completed at least 7 years of service in the Gazetted Unnumbered First and Second Class posts and have passed the postgraduate course to participate in the open and internal competition for the Gazetted Second and First Class posts.
16. Representation of official trade unions should be ensured when deciding on matters related to employees, including federal civil service, state civil service, and local service act, law-making and service facilities.
17. In the case of Judicial Service, Foreign Service, and Audit Service posts, the percentage will not be allocated for the Gazetted Third Class Inter-Level Competition, so the percentage of the inter-level competition should be included in the promotion percentage.
