Writ to Supreme Court not to allow Kailali Mohanyal's chairman to participate in Jesus election
Dhangadhi: A case has been filed in the Supreme Court in Kailali's Mohanyal village municipality demanding that Devidatta Upadhyaya, who was elected chairman, be barred from participating in the Himshikhar District Coordination Committee election. He has been suspended after he was elected as the village chairman after filing a corruption case in a special court.
While the issue of corruption is under consideration, the authority has written a letter to the Ministry of Federal Affairs and General Administration, the Election Commission and the concerned local level to implement the provision of automatic suspension.
Even after the authorities sent a letter to the concerned body to suspend Upadhyaya, a writ petition was filed against him after his name was published in the District Coordination Committee. In the writ filed by advocate Basanta Jaishi, an interim order has been sought not to include Upadhyaya in the published voters' list for the upcoming District Coordinating Committee election on December 12, saying that he has been suspended till the end of his case.
The Commission for Investigation of Abuse of Authority had filed a case in a special court on April 20 alleging that he had committed corruption while he was the ward chairman of the village municipality.
While there was a case in the court, Upadhyay got 3,134 votes and was elected as the chairperson from the Maoist center. He was also supported by the Nepali Congress and the CPN-Unified Socialists. Although he won the election, the swearing-in was stopped. However, he was sworn in a few days later. Shortly after being sworn in as chairman, the commission again wrote a letter to the concerned body to suspend him. UML has protested that the office of the Chief Electoral Officer has not removed his name even after his suspension.
